Carry limit vs home limit
The home limit is more than 26 times the carry limit. Both are set by New York Penal Law.
5 lb = 80 oz. Source: Penal Law 222.05 and 222.15.
Is there a purchase limit at the dispensary?
Yes. A licensed store can't sell you an amount that would put you over 3 oz of flower or 24 g of concentrate, and the state flags same-day purchases that add up past those numbers. Delivery follows the same cap per day. Shopping for flower in Queens? An eighth is 3.5 g, so 3 oz is about 24 eighths.
What counts toward each limit
| Product | Limit it counts toward |
|---|---|
| Flower and pre-rolls | 3 oz of cannabis |
| Vapes and concentrates | 24 g of concentrated cannabis |
| Edibles and oil | 24 g of concentrated cannabis (OCM) |
What's allowed and what isn't
| Rule | |
|---|---|
| Legal | Carry up to 3 oz of flower and 24 g of concentrate in public, age 21+ |
| Legal | Keep up to 5 lb at home, secured from anyone under 21 |
| Legal | Give up to 3 oz / 24 g for free to another adult 21+ |
| Legal | Grow 3 mature and 3 immature plants per adult, 6 and 6 per household |
| Illegal | "Gifting" cannabis with a paid item or service |
| Illegal | Selling cannabis you grew at home |
| Illegal | Taking cannabis into or out of New York |
Edibles count toward the 24 g concentrate limit, not the 3 oz flower limit.
